Aggravated Assault

Aggravated Assault is a offence under the Criminal Code of Canada. It is the most serious form of assault and a person found guilty of Aggravated Assault are liable to imprisonment for a term not exceeding fourteen years. The charge requires conduct that results in serious and potentially life-endangering harm to another.

The charge of Aggravated Assault is commonly seen in both domestic and non-domestic situations and may be laid alongside other offences such as Uttering Threats, Assault with a Weapon, or Mischief.  It is far less common than Assault with a Weapon or Causing Bodily Harm, and requires a degree of injury to the victim that is significantly more serious.  Under the Criminal Code of Canada:

(1) Every one commits an aggravated assault who wounds, maims, disfigures or endangers the life of the complainant.

Given the serious nature of these charges, it is difficult to determine whether this type of offence could be dealt with at the resolution stage.  Simply, it is likely that the best possible outcome may only occur through a trial.  If you are interested in discussing your Aggravated Assault charge in BC, you are welcome to call the office for a free consultation.
